Overview

Momentum LLC (“we,” “our,” or “us”) values your privacy and is committed to protecting it. This Privacy Policy explains how information is collected, used, stored, and safeguarded when you use the Momentum mobile application (“the App”).

Information We Collect

Momentum is designed to keep your data on your device. All content you create within the App — including tasks, reminders, notes, routines, and preferences — is stored locally on your device using Apple’s on-device storage frameworks and is not transmitted to our servers unless a feature specifically requires it.

When you enable time-triggered reminder notifications, limited data is sent to our server solely to deliver the notification at the scheduled time. This includes:

This data is used exclusively to trigger the notification at the correct time and is not persistently retained after delivery.

If iCloud sync is enabled, your data may also be stored in your personal iCloud account managed by Apple. See the iCloud Sync section below for details.

Automatically Collected Information

When the App communicates with our servers, our infrastructure providers may automatically log technical information such as your IP address, device type, and operating system as part of standard server operations. We do not actively collect, access, or use this information to identify you.

If the App experiences an error or crash, we may collect limited technical information to diagnose and resolve the issue. This technical data is not used to personally identify you.

Analytics and Usage Data

Momentum may use analytics tools to understand overall app performance and feature usage. Any analytics data collected would be aggregated and non-identifiable, and would be used solely to enhance functionality and user experience.

iCloud Sync

Momentum may offer the ability to sync your data across your devices using Apple’s iCloud service. If enabled, your data is stored within your personal iCloud account and is managed by Apple. We do not have access to data stored in your iCloud account. Apple’s handling of iCloud data is governed by Apple’s own privacy policy.

How We Use Your Information

We use collected information to operate and improve Momentum, deliver scheduled notifications, manage subscriptions and payments, communicate important updates or new features, and maintain the security, reliability, and performance of the App. Your data is never used for advertising or unrelated purposes without your permission.

Legal Basis for Processing

We process personal data based on your consent to use Momentum’s features that require server communication, our legal obligations to protect user information, and our legitimate interest in maintaining and improving the App and its features, provided those interests do not override your rights or freedoms.

Screen Blocking & App Usage Monitoring

Momentum includes optional screen blocking and app usage monitoring features designed to support focus and self-regulation. All usage data collected by these features is processed and stored entirely on your device and is not shared with third parties.

Data Sharing

We do not sell your personal data. We may share limited information with trusted third-party service providers who help operate Momentum, such as cloud infrastructure, analytics, or notification delivery services. These providers are permitted to use data only as necessary to perform services on our behalf.

Subscription payments are processed by Apple through the App Store. We do not receive or store your payment information. Apple’s handling of payment data is governed by Apple’s own privacy policy.

Cookies and Tracking Technologies

Our website, if applicable, may use cookies and similar technologies to improve functionality, understand usage patterns, and enhance content relevance. Cookies help us learn how users interact with our services so we can continue improving them.

Data Retention

Your tasks, reminders, routines, and all other content created in Momentum are stored on your device. This data persists on your device until you delete it or uninstall the App. If you use iCloud sync, your data is retained in your iCloud account according to Apple’s retention policies.

Reminder scheduling data sent to our server is processed transiently and is not stored in a persistent database. This data may exist temporarily within cloud infrastructure until the notification is delivered, after which it is discarded. Server infrastructure logs may retain limited technical information for up to 30 days.

Data Security

We implement reasonable administrative and technical safeguards to protect your information, including HTTPS encryption for all server communication. On-device data is protected by your device’s built-in security features. However, no system can guarantee absolute security.

Children’s Privacy

Momentum is not intended for children under the age of 13, and we do not knowingly collect personal information from children.

Changes to This Policy

We may update this Privacy Policy periodically. Any changes will be reflected by an updated revision date at the top of this document.

IMPORTANT NOTICE — PLEASE READ CAREFULLY

These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Momentum LLC ("Momentum," "we," "our," or "us") governing your access to and use of the Momentum application, including all related software, features, content, and services (collectively, the "App" or "Service").

By downloading, installing, or otherwise accessing or using the App in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the App.

Arbitration Notice: Except for certain disputes described in Section 17 (Dispute Resolution), you agree that disputes with Momentum will be resolved through binding individual arbitration. You are waiving the right to a trial by jury and the right to participate in any class action or representative proceeding.

1. ABOUT MOMENTUM

Momentum is a productivity and focus application designed to help individuals manage tasks, reminders, routines, goals, and screen-time habits. The App provides structured tools and behavioral reinforcement features including focus timers, task management, routine tracking, habit formation tools, daily planning, and screen-time management features ("Screen Features").

Momentum is intended to be used as a personal productivity aid. It is not a medical device, therapeutic tool, or clinical resource and should not be used as a substitute for professional medical, mental health, or behavioral health treatment.

2. ELIGIBILITY

You must be at least 13 years of age to use Momentum. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the App, you represent and warrant that: (a) you are at least 13 years old; (b) you have the legal capacity to enter into a binding agreement under the laws of your jurisdiction; (c) you are not prohibited by any applicable law from using the App; and (d) if you are accepting these Terms on behalf of a company or other legal entity, you have the authority to bind that entity.

The App is operated from the United States. We make no representation that the App is appropriate or legally available in all jurisdictions. Access to the App from territories where such access is illegal is prohibited. You are solely responsible for compliance with applicable local, national, or international laws.

3. SUBSCRIPTIONS AND PAYMENTS

Momentum may offer both a free tier and paid subscription plans ("Subscription"). Certain features of the App are only available to subscribers. Details about features and pricing are available within the App and on our website.

Subscriptions are processed and managed through your app store provider (e.g., Apple App Store or Google Play Store) ("App Store"). Your relationship with the App Store regarding payment, billing, renewals, refunds, and cancellations is governed by the App Store's own terms. We do not have access to your payment method information and are not responsible for App Store billing errors or disputes.

Unless you cancel your Subscription before the end of the then-current billing period, your Subscription will automatically renew for successive periods at the then-current price. You may cancel at any time through your App Store account settings. Cancellation takes effect at the end of your current billing period. Momentum does not provide refunds for any unused portion of a paid subscription period, except as required by applicable law.

Momentum reserves the right to change subscription pricing at any time. We will provide reasonable advance notice of any price changes. Your continued use of the App after a price change constitutes your agreement to pay the modified price.

Momentum may offer free trial periods for paid Subscriptions. Free trials are available only to new subscribers. At the end of a free trial, your Subscription will automatically convert to a paid Subscription unless you cancel before the trial period ends.

4. USER RESPONSIBILITIES

You are solely responsible for your use of the App, all content you create or submit through the App, and all consequences thereof. You agree to use the App only for lawful purposes and in accordance with these Terms.

You are solely responsible for maintaining adequate backups of any data, content, or information you store within the App. Momentum is not intended to serve as a primary or sole data storage solution. We are not liable for any loss of user data.

If you are a parent or guardian who has permitted a minor to use the App, you assume full responsibility for supervising that minor's use and ensuring compliance with these Terms.

5. ACCEPTABLE USE

By using the App, you agree that you will NOT:

We reserve the right to investigate violations of these Terms and may, in our sole discretion, issue warnings, suspend or terminate access, remove content, or report conduct to law enforcement authorities.

6. INTELLECTUAL PROPERTY RIGHTS

All rights, title, and interest in and to the App and its content, features, and functionality — including software, code, algorithms, databases, design, graphics, user interface, branding, trademarks, logos, and all other proprietary materials (collectively, "Momentum IP") — are and will remain the exclusive property of Momentum LLC and its licensors. Nothing in these Terms transfers any ownership interest in Momentum IP to you.

Subject to your compliance with these Terms, Momentum grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use. This license does not include the right to modify or create derivative works of the App, publicly distribute the App, use the App for commercial purposes, or remove any proprietary notices.

If you provide Momentum with any feedback, suggestions, or ideas regarding the App ("Feedback"), you hereby grant Momentum a worldwide, irrevocable, perpetual, royalty-free license to use, reproduce, modify, distribute, and display such Feedback for any purpose, without compensation or attribution to you.

Momentum respects intellectual property rights. If you believe that any content on the App infringes your copyright, please contact us at into@usemomentumapp.com with a description of the copyrighted work, the location of the allegedly infringing material, your contact information, a statement of good faith belief that the use is unauthorized, and a statement under penalty of perjury that you are the copyright owner or authorized to act on their behalf.

7. USER CONTENT

As between you and Momentum, you retain all ownership rights in and to the content, data, tasks, notes, routines, and other information you create or store within the App ("User Content").

By creating or submitting User Content to the App, you grant Momentum a limited, non-exclusive, worldwide, royalty-free license to access, use, store, reproduce, and process your User Content solely to the extent necessary to provide the App's features to you, maintain and improve the App, and comply with applicable legal obligations. This license terminates when you delete your User Content or cease using the App, subject to any legally required retention.

You represent and warrant that you own your User Content or have sufficient rights to grant the license above, and that your User Content does not infringe any third-party rights or violate any applicable law.

Momentum does not guarantee that your User Content will be stored indefinitely. You are solely responsible for maintaining independent copies. We reserve the right to delete User Content that violates these Terms.

Momentum may collect, use, and share aggregated and anonymized data derived from your use of the App (from which your identity cannot reasonably be determined) for analytics, product improvement, research, and marketing. Such data is owned by Momentum.

8. PRIVACY AND DATA

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully to understand how we collect, use, store, and disclose your personal information.

Momentum implements commercially reasonable technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

The App is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have done so, we will take steps to delete that information promptly.

By using the App, you consent to receiving electronic communications from Momentum, including product updates, service announcements, and administrative messages. You may opt out of promotional communications at any time by following the unsubscribe instructions in our emails or updating your notification preferences in the App.

9. SCREEN BLOCKING AND FOCUS FEATURES

Momentum's screen management and focus features ("Screen Blocking Features") are designed to help users limit access to certain applications or content during designated focus periods. These features are voluntary self-regulation aids only.

Screen Features operate within the constraints imposed by your device's operating system and platform policies. Due to these constraints, Screen Features may not function perfectly, consistently, or at all on all devices or operating system versions. Momentum does not guarantee that Screen Features will be effective in all circumstances.

You acknowledge that Screen Features are provided on a best-effort basis. Momentum makes no warranty that Screen Features will block all access to designated content or produce any particular productivity outcome. Do not rely on Screen Features as the sole mechanism to prevent access to emergency services, critical communications, or any content where uninterrupted access is essential to your safety or wellbeing.

10. THIRD-PARTY SERVICES AND INTEGRATIONS

Momentum may rely on third-party service providers for infrastructure, analytics, payment processing, authentication, and other services. These providers are subject to their own terms and privacy policies. Momentum is not responsible for the practices, acts, or omissions of any third-party provider.

The App may offer optional integrations with third-party applications or services. Your use of any such integration is subject to that third party's own terms and privacy policies. Momentum does not endorse or assume responsibility for third-party integrations. Any data you share with a third party through an integration is governed by that third party's policies.

The App may contain links to third-party websites. These links are provided for convenience only. Momentum does not control such websites and is not responsible for their content or any other aspect thereof.

11. SERVICE AVAILABILITY AND MODIFICATIONS

Momentum does not guarantee that the App will be available at all times or that access will be uninterrupted, timely, or error-free. We may suspend or restrict access to the App for maintenance, updates, security purposes, or for any other reason, with or without notice.

Momentum reserves the right to modify, update, enhance, reduce, or discontinue any feature or functionality of the App at any time, temporarily or permanently, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any of its features.

From time to time, Momentum may offer access to beta features or experimental functionality ("Beta Features"). Beta Features are provided on an "as is" basis and may be less stable than the general release App. Momentum may discontinue any Beta Feature at any time, and your use of Beta Features is at your own risk.

12. DISCLAIMERS

THE APP AND ALL CONTENT, FEATURES, AND SERVICES MADE AVAILABLE THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOMENTUM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MOMENTUM DOES NOT WARRANT THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL OPERATE IN AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE MANNER; (C) RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE APP WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOMENTUM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOMENTUM'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO MOMENTUM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY U.S. DOLLARS ($50.00).

Some jurisdictions do not allow these limitations, so they may not apply to you in full. In such jurisdictions, Momentum's liability shall be limited to the fullest extent permitted by law.

14. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Momentum LLC and its affiliates, officers, directors, employees, contractors, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or inability to use the App; (b) your breach of any provision of these Terms; (c) your User Content; (d) your violation of any applicable law; or (e) your violation of the rights of any third party.

Momentum reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.

15. TERM AND TERMINATION

These Terms are effective from the date you first access or use the App and continue until terminated. You may stop using the App at any time. Momentum may, in its sole discretion, with or without notice, suspend your access to the App temporarily or terminate your access permanently for any reason, including but not limited to violation of these Terms, fraudulent or illegal activity, or conduct harmful to other users or Momentum.

Upon termination: (a) all licenses granted to you under these Terms will immediately terminate; (b) you must cease all use of the App and delete all copies from your devices; and (c) you will lose access to all User Content stored in the App.

The following Sections shall survive termination: Sections 6 (Intellectual Property), 7 (User Content), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 16 (Governing Law), 17 (Dispute Resolution), 18 (Class Action Waiver), and 20 (General Provisions).

16. GOVERNING LAW

These Terms and any disputes arising out of or relating to these Terms or your use of the App shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to conflict of law provisions. Subject to Section 17, you consent to the exclusive jurisdiction of the state and federal courts located in Ada County, Idaho for the resolution of any dispute not subject to arbitration.

17. DISPUTE RESOLUTION AND ARBITRATION

Before initiating any formal dispute resolution proceeding, you agree to contact Momentum at into@usemomentumapp.com with a written description of the dispute and the relief sought. You and Momentum will attempt in good faith to resolve the dispute informally within 30 days.

If informal resolution fails, all disputes arising out of or relating to these Terms or your use of the App that cannot be resolved in small claims court shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Ada County, Idaho, or by telephone or video conference at your option if your claim is for $10,000 or less.

Either party may bring an action in small claims court for disputes within the scope of that court's jurisdiction. Either party may also seek emergency injunctive relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

You may opt out of the arbitration agreement within 30 days of first accepting these Terms by sending written notice to into@usemomentumapp.com with the subject line "Arbitration Opt-Out," your full name, and a clear statement that you wish to opt out.

18. CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MOMENTUM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

If this waiver is found unenforceable, the entirety of Section 17 (Dispute Resolution and Arbitration) shall be void and any such disputes shall be resolved in a court of competent jurisdiction.

19. CHANGES TO THESE TERMS

Momentum reserves the right to update or modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms. Where changes are material, we will provide additional notice, such as by email or a prominent notice within the App.

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue using the App before the effective date of the changes.

20. GENERAL PROVISIONS

These Terms, together with the Privacy Policy and any other agreements incorporated by reference, constitute the entire and exclusive agreement between you and Momentum regarding your use of the App.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

Momentum's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

You may not assign or transfer your rights or obligations under these Terms without Momentum's prior written consent. Momentum may freely assign these Terms without restriction.

Momentum shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control, including acts of God, natural disaster, government actions, power outages, or internet disruptions.

21. NOTICE TO APPLE / iOS USERS

These Terms are between you and Momentum only, not with Apple Inc. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund any applicable purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for any claims relating to the App, including product liability claims, consumer protection claims, or claims that the App fails to conform to applicable legal requirements. Apple is not responsible for the investigation or settlement of any third-party intellectual property infringement claims related to the App.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms as a third-party beneficiary. You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited or restricted parties list.

22. NOTICE TO CALIFORNIA RESIDENTS

Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by calling (800) 952-5210.

23. NOTICE TO EU, EEA, AND UK USERS

If you are located in the European Union, European Economic Area, or United Kingdom, additional rights may apply to you under applicable consumer protection and data protection laws, including the GDPR. Nothing in these Terms limits rights that cannot be waived under applicable EU, EEA, or UK law. Disputes may also be submitted to the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
